The lawsuit, filed in 2017 in The Bronx where Diagne lived at the time, alleges that on January 30, 2016, Diagne was driving a company car on Flatbush Avenue in Brooklyn when his vehicle "made contact" with pedestrian Jennifer Antoine, seriously injuring her. The suit claims both Diagne and the company that owned the car were "negligent, careless, reckless, [and] grossly negligent" in the operation and control of the vehicle. As a result, the lawsuit states that Antoine "sustained severe and permanent personal injuries, became sick, sore, lame and disabled; suffered injuries to her nervous system; suffered mental anguish, was confined to hospital, bed and home and may, in the future, be so confined." The resolution of the case was not immediately known.
