A new law in Delaware gives state agencies the authority to enforce noise complaints about dogs that bark excessively. The law prohibits dogs from barking continuously for more than 15 minutes or more than 30 minutes in total per day, with fines starting at $50 for repeat offenders. The law includes exemptions for service dogs, dogs in training, and dogs that are being provoked.
Why it matters
The new law aims to address a longstanding dispute between New Castle County and the state over who is responsible for enforcing dog barking complaints. It provides a statewide framework to help residents find relief from disruptive dog noise, which can significantly impact quality of life, especially in densely populated areas.
The details
The Delaware Office of Animal Welfare and Department of Agriculture have been given the authority to enforce the new law, with assistance from police if needed. Violators will first receive a written warning, followed by fines of $50 for a second offense, $100 for a third, and $150 for subsequent violations. The law does not prohibit municipalities from enforcing their own dog noise ordinances.
- The law took effect on October 9, 2025.
- It was signed into law by then-Governor John Carney in 2024.
